Instances of animal abuse in India are on the rise lately. E.g. killing of Shaktiman Horse, throwing dogs from roof in Kerala, making an elephnat walk in jungle under scorching sunlight until it collapsed etc.

Recently Supreme Court had put a stay on Andhra Pradesh High Court’s order allowing joint police and district administration teams to seize roosters primed for traditional fights. The fights are conducted by farmers as part of the Pongal/Sankranti celebrations in Andhra Pradesh and Tamil Nadu.

Animal Welfare Board of India and PETA have been actively fighting for animal rights in India in recent times.

Other cases of animal cruelty:

Circus animals tortured in name of livelihood.

Animal experimentation, hunting animals etc. are also an act of cruelty on animals.

SC has questioned the caging of exotic birds and advocated their fundamental right to fly and it focuses on pet animal’s rights here.

Agenda involves whether the animals have rights of their own or are they subservient to the human rights.

We definitely need to put animal rights in place, promote and maintain it.

Animals are not independent and can’t think like the humans do. These animals were put on earth to serve human beings and are seen as a means to livelihood especially in poor economies.

Convention on Biological Diversity and intangible heritages, safeguards knowledge and practices concerning nature and the universe thus in pretext of conserving our traditions it becomes an incentive to raise native livestock.

Animals have independent rights as they have their own conscience and can feel love and pain like humans do. They have equal rights to live freely and concerns should be raised protecting them against any human oriented selfish motives

What needs to be done?

  • Culture should be promoted but not at the behest of animals being tortured.
  • Moral Duty to promote compassion towards animals.
  • Humans should show empathy towards other living being.
  • Farmers breed animals as a means of livelihood and so exercise control over animals for their survival.

Some important legal scenarios pertaining to animal rights.

  • Art 19(1) (g) -Right to a vocation – gives right to choose any occupation. So humans can choose any means to livelihood. But the ends of the livelihood should also be justified. The breeder should ensure that the person buying the animal is not buying to torture it.
  • Violating the rules and laws like Prevention of Animal Cruelty Act in the name of tradition.Law is universal and promotes equality. Tradition should not be a reason to violate laws.

International community is now becoming considerate on animal rights. Recently Catalonia State has banned bullfighting.

Conclusion: "A man can live and be healthy without killing animals for food therefore if he eats meat,he participates in taking animal's life merely for the sake of his appetite. And to act so is immoral."-Leo Tolstoy.

However there always will be a sustained conflict, as animals need to be protected as well as used for livelihood. There is an inevitable control over animals for the survival of human race, this fact can’t be ignored but definitely a sense of moral duty can be evoked in every individual to draw a line between using them and torturing them. Excessive exploitation of these animals not only projects the disdained human values but also disturbs the ecology completely. Therefore to guard such unjust activities legal scenario should be strengthened.

“The greatness of a nation and its moral progress can be judged by the way its animals are treated.” - Mahatma Gandhi.
