Detailed Discussion On Consumer Protection Act 2019

Today in era of globalization, the market dynamics and trade practices are changing at the fast rate and old consumer protection act of 1986 was not sufficient to tackle new kind of unfair and unethical trade practices. Considering this problem the government reacted by replacing old consumer protection act by entirely new act.

Features of the act
  • A consumer defined as a person who buy any good or avail any service for personal use(not for commercial purpose) using all mediums of transaction i.e. offline, online modes.
  •  The act define consumer rights as
    • Right to be protected against the marketing of any goods or services which is hazardous to the life or property.
    • Right to consumer awareness
    • Right to redressal of complaints in-front of competent forum.
    • Right to be informed about the quality, quantity, potency, purity, standard and price of goods, products or services.
    • to be assured of access to a variety of goods, products or services at competitive prices.
  • Consumer Protection Councils will be established at the district, state and national levels to render advise on consumer protection.
  • Consumer Disputes Redressal Commissions will be set up at the District, State and National levels for adjudicating consumer complaints. Appeals from the District and State Commissions will be heard at the next level and from the National Commission by the Supreme Court.
  • Central Consumer Protection Authority will be set up to promote, protect and enforce consumer rights. It can issue safety notices for goods and services, order refunds, recall goods and rule against misleading advertisements.
  • The act specified the liability of a product manufacturer, service provider or seller to compensate a consumer for any harm or injury caused by a defective good or deficient service.
Problems associated with new act There were three fundamental problems which are followings
  • The definition of consumer rights is complicated to understand by common man.
  • It is not specify to whom the consumer protection council will tender advice.
  • It is not specify that consumer dispute redressal  commission will contain one judicial member. If commission has all the members from executive branch than it'll violate the separation of power norm.
Conclusion: This act is good move to provide a shield to the consumers in fast growing digital market.The Act addresses consumer concerns arising from technological advancements in the marketplace, and broadens the scope of grounds for which action can be initiated.
