In order to promote transparency and accountability in the working of public authority, RTI act was passed by parliament in 2005. RTI is a legal right for every citizen.

This act had the provision for constitution of Central information Commission(CIC) and State information Commission (SIC). These are quasi-judicial authorities.

Government proposed a bill to amend sections 13, 16, and 27 of the RTI act. This bill is seen as a twin attack on accountability and the idea of federalism.

Proposed amendments in the bill

Section 13' s original provisions
  • Term of central Cheif Information Commissioner (CIC) and information Commissioner sets at five years.
  • The salaries, allowances and other service conditions of the CIC shall be same as the Cheif Elections Commissioner (CEC) and those of other information Commissioners shall be same as that of Election Commissioners.
Proposed amendments
  • Term may be prescribed by central government.
  • Other service conditions may also be prescribed by central government.
Section 16 
  • Deals with the term and other service conditions of state level CIC and information Commissioners.
Proposed amendments
  • It allows central government to control through rules, the terms and conditions of appointment of Commissioners in the states.
The status of central Information Commissioners has been brought on par with the Election Commissioners and the status of State Information Commissioner with the Cheif Secretary in the states so that they can function in an independent and effective manner.

Issues in the proposed amendment

The RTI has been used to question every public institution on matter of public interest starting from RBI to CBI, CVC etc and some essential issues like unemployment figure, NPAs, electoral bonds, demonization etc and RTI is effective to get information from higher institutions due to independence and high status of information Commission. 

It is essential to note in the organisational structure of any independent authority like CVC, the Election Commissioners, the Lokpal etc one thing is common i.e. security of tenure.

Thus it is clear that Information Commission is playing very essential role to maintain the fundamental of democracy. These amendments will lead to the dismantling of transparency architecture and forcing commission to work as one government department rather than independent body.

Violate the constitutional provision of federalism.

Concluding remark: When power is centralised, the freedom of expression is threatened which can lead to the decline of democracy. In a democracy, there should be provisions of checks and balances to regulate the malafide functionings of top institutions and through these amendments government deliberately weakening this essential provision which is not healthy for the country.
